By submitting an application for Personal Coaching, scheduling a coaching session, or otherwise proceeding with a Personal Coaching engagement, the client confirms that they have read, understood, and agreed to this Coaching Agreement.
This Coaching Agreement applies to all Personal Coaching engagements with Michael Hegeman conducted through Hegeman Coaching.
By entering into a Personal Coaching engagement, the client confirms that they have read, understood, and agreed to the terms set out below.
Nature of the Coaching Relationship
Personal coaching is a structured, reflective process focused on clarity, decision-making, responsibility, and deliberate action.
Coaching is not therapy, counselling, mental health treatment, medical care, legal advice, or financial advice. Coaching does not diagnose, treat, or address mental health conditions.
The client remains fully responsible for their decisions, actions, and outcomes during and after the coaching engagement.
Scope of Coaching
Coaching sessions are conducted one-to-one and may take place via video communication or other agreed formats.
Coaching focuses on thinking, judgment, direction, and action. It does not involve instruction, advice-giving, or direction in the sense of telling the client what to do.
The coach does not make decisions on behalf of the client.
Confidentiality
Coaching sessions are confidential.
Information shared during coaching sessions is not disclosed to third parties except where disclosure is required by law or necessary to comply with legal obligations.
The coach determines the communication platform used for coaching sessions. The client is responsible for ensuring privacy on their own side, including their choice of location, device security, and preventing any unauthorised recording or access.
Recording and Use of Sessions
Coaching sessions are conducted live.
Coaching sessions may not be recorded, stored, or reproduced in audio, video, screen capture, or any other form by the client, whether in whole or in part, without prior written consent.
This includes recording via external devices, software, screen capture tools, or storage on personal, cloud-based, or third-party systems.
Any materials, insights, or content arising from coaching sessions are for the client’s personal use only and may not be shared, published, distributed, or used for commercial purposes.
Intellectual Property
All materials, concepts, language, and frameworks shared during coaching sessions are protected by copyright and intellectual property law.
The client may use insights gained for personal use but may not reproduce, distribute, teach, publish, or commercialise coaching content without prior written permission.
Fees, Sessions, and Scheduling
Personal coaching is offered in structured, multi-session engagements as described on the Personal Coaching page.
Sessions are scheduled by mutual agreement.
Missed sessions or late cancellations may not be refundable, as outlined in the Refund and Returns Policy.
Refunds and Cancellations
Refunds and cancellations are governed by the Refund and Returns Policy published on the website.
Once a coaching session has taken place, that session is non-refundable.
If, after the first session, it becomes clear in the judgment of either party that the coaching engagement is not a suitable fit, remaining unused sessions may be refunded in accordance with the Refund and Returns Policy.
Technical Issues
Coaching sessions rely on third-party communication technology and internet connectivity.
Hegeman Coaching is not responsible for technical issues, interruptions, or failures caused by factors outside its reasonable control, including internet connectivity, platform outages, device malfunction, or service disruptions.
Where technical issues materially affect a session, reasonable efforts will be made to reschedule or continue the session where possible.
Right of Withdrawal
By entering into a Personal Coaching engagement and scheduling sessions, the client expressly requests that coaching services begin.
The client acknowledges that once a coaching session has taken place, the right of withdrawal is limited in accordance with applicable consumer law and the Refund and Returns Policy.
Limitation of Liability
Coaching is provided for personal and professional development purposes only.
To the extent permitted by law, Michael Hegeman and Hegeman Coaching are not liable for decisions, actions, outcomes, or consequences arising from coaching sessions.
Nothing in this agreement limits liability where such limitation is not permitted under applicable law.
Governing Law
This Coaching Agreement is governed by and interpreted in accordance with Dutch law.
Any disputes arising from this agreement shall be subject to the jurisdiction of the courts of the Netherlands.
